GALLIPOLIS — A Franklin County man charged in connection with two summer break-ins in Gallia County was recently sentenced in the Gallia County Common Pleas Court.

Charles E. Logan, 43, Galloway, Ohio, was sentenced late last week to serve a two and a half year sentence in the Ohio Department of Rehabilitation and Correction for breaking into Baxter’s Harley Davidson and Bridgeport Equipment and Tool in Spring Valley on July 31.

Logan was also ordered to pay $917.15 in restitution to Baxter’s Harley Davidson.

This sentence was ordered to be served concurrently with sentences imposed in three separate Franklin County cases.

According to the Franklin County Clerk of Courts website, Logan pleaded guilty to two counts of breaking and entering, offenses occurring on February 19, 2012, receiving stolen property, an offense that occurred on January 29, 2012, and to failing to appear on July 23, 2012.

He was sentenced to serve a 12 month sentence for breaking and entering, a 12-month sentence for receiving stolen property and six months for failing to appear — all sentences to be served consecutively with each other.

The defendant was given credit for 125 days served.

Logan was charged in Gallia County along with William Zinn, 29, Oak Hill; James H. Moore, 29, Middleport; Joseph Syrus, 32, Gallipolis; and Michael S. Henderson, 40, Gallipolis, in relation to the break-ins and theft of thousands of dollars worth of merchandise from two local business.

Deputies with the Gallia County Sheriff’s Office were first made aware of the break-in at Baxter’s Harley Davidson after a suspect who was fleeing a trooper with the Ohio State Highway Patrol on an orange Harley Davidson motorcycle was apprehended near Lariat Drive off of Jackson Pike during the early morning hours of July 31.

After fleeing from the trooper on the motorcycle, the suspect, in an attempt to escape pursuing officers, left the motorcycle unattended in the Spring Valley area and fled on foot.

A sheriff’s office K-9 unit was called to the scene and the suspect was tracked to a yard behind a residence on Lariat Drive. A K-9 officer with the Gallipolis Police Department was called in to assist the deputy and the suspect was located hiding in a boat behind the Lariat Drive residence.

Reportedly, the suspect, later identified as Logan, was wearing Harley Davidson clothing, and, after being patted down, a large sum of money was removed from his pockets.

The Harley shop was then checked for activity, and it was found that the front door of the business had been breached with a rock.

Crime scene investigators with the Ohio Bureau of Criminal Identification and Investigation were called to the scene to assist with the investigation.

The owners of the store were advised of the break-in and later arrived on scene and confirmed that a 2012 orange Harley Davidson had been stolen from their business along with cash and several other items.

While investigating the break-in at the motorcycle dealership, deputies were alerted to a second break-in at nearby Bridgeport Equipment and Tool.

According to the police report, the sales manager of the business had arrived for work early that morning and had found that the front door of the business had been busted out and entry had been made into the building.

Employees with Bridgeport further advised that they had video surveillance of the two suspects inside the store during the break-in.

The property taken from Bridgeport, including a safe, cash, several chainsaws, generators, clothing and other items, was later recovered by deputies.

Logan, who initially provided officers with a false name, as well as Zinn, were identified as suspects and arrested following the initial investigation.

Both were later indicted by a grand jury on multiple charges.

In addition to two breaking and entering charges, Logan and Zinn were both charged with the theft of $40,000 of personal property from the Harley shop and $30,000 of personal property from Bridgeport.

Logan was also charged with the theft of a 2012 Harley Davidson motorcycle valued at $17,600.

Zinn has also been charged with a June 17 burglary of a Raccoon Township residence. He is currently being held in the Gallia County Jail.

The three other individuals identified as suspects in the break-in at Baxter’s and Bridgeport — Moore, Syrus and Henderson — were also later arraigned in the common pleas court on various charges.

Moore pleaded not guilty to receiving stolen property, safe-cracking and tampering with evidence.

The defendant was reportedly in the possession of a safe containing checks and cash belonging to Bridgeport equipment on July 31. He also allegedly later disposed of this safe by pushing it over a guardrail.

A status conference in this case was recently held and it is scheduled for a jury trial on January 23, 2012.

Syrus was charged with receiving stolen property, as well as aiding or abetting Logan with the theft of a safe and aiding or abetting James Moore with safecracking.

A nolle prosequi was later filed and the prosecution of the case was stopped. The defendant agreed to be assessed the costs of the action.

Henderson has pleaded not guilty to two counts of receiving stolen property, aiding or abetting Zinn in the theft of property from Baxter’s and Bridgeport Equipment and aiding or abetting Syrus with the theft of a safe.

A plea in this case may be filed by December 28. A jury trial has been set for January 28, 2013.
