Pleas resolve local roadside robbery case

GALLIPOLIS — The second and final suspect in the roadside robbery that occurred on Aug. 3, 2006 on Safford School Road has pled guilty and now awaits sentencing.

Charles V. McDonald, 40, 551 Arbuckle Road, Gallipolis, who was indicted by the Gallia County grand jury for aggravated robbery, two counts of kidnapping and impersonating a police officer, pled guilty on Feb. 20 to attempted robbery and two counts of attempted abduction, all fourth-degree felonies.

The impersonating a police officer charge was dismissed.

As part of the plea agreement, the state is recommending a sentence of 18 months of incarceration for each count, with two of the sentences to be served concurrently for a total of three years.

The state also recommends McDonald be ordered to pay restitution to the victim in the amount of $1,104.50 and agree to forfeit to the Gallia County Sheriff’s Office the confiscated 1998 Toyota Tacoma truck.

The state and victims will also agree to stand silent on McDonald’s motion for judicial release after he has served two years of his sentence.

Sentencing is tentatively set for Friday, March 16 at 10 a.m.

William Michael Carter, 32, 500 Ingleside Camp Road, Gallipolis, the second suspect in the robbery, pled guilty to attempted robbery and two counts of attempted abduction on Jan. 19.

Carter was sentenced on Feb. 12 to the Ohio Department of Rehabilitation and Corrections for 18 months for each count, two of which will be served concurrently for a total of three years.

Carter was ordered to pay $1,104.50 in restitution to the victim and all costs of prosecution.

McDonald and Carter were arrested after Carter used his vehicle to block the car of Lewis S. Gillenwater and Larry J. Gillenwater, both of Crown City, on Safford School Road while the two victims were on their way to make a bank deposit of a “sizable amount.”

McDonald then blocked the Gillenwater car from behind with another vehicle, approached on foot and ordered the men from the car at gunpoint, where they were handcuffed, robbed and left by the side of the road.
