GALLIPOLIS — A Gallia County man wanted for probation violations in a 2011 burglary case, was charged last week in connection with a second burglary that occurred early this year.

Trevor S. Mullins, 23, Vinton, was charged with one count of burglary, one count of theft and one count of possessing criminal tools following a break-in at a residence located in the Thurman area on January 7.

The indictment in this case, filed on February 8, alleges that Mullins entered a residence on Tyn Rhos Road on January 7, stole a Model 63 Smith & Wessen revolver and was in the possession of a pry bar and black gloves on the day of the incident.

Mullins was arrested at approximately 12:30 p.m. on January 7 following a traffic stop in Rio Grande.

Reportedly, a deputy was called in to assist a trooper with the Ohio State Highway Patrol who had found Mullins, as well as Jeremy A. Gibson, 26, Vinton, and Kelly Nichole Murray, 23, Gallipolis, in possession of the items reported as stolen from the Thurman-area residence, including a flat screen television, miscellaneous jewelry, iPods, a .22 revolver and assorted DVDs.

Documents filed with the Gallia County Clerk of Courts indicate that Mullins was reportedly riding in trunk of the car being driven by Gibson at the time of the traffic stop.

A deputy with the Gallia County Sheriff’s Office was later dispatched to the residence on Tyn Rhos Road at approximately 4 p.m. on January 7 after the owner of the home returned to find the residence ransacked.

According to the police report, the deputy discovered pry marks on the back door of the residence, indicating that entry was made through the rear door.

The homeowner later provided a list of the items stolen from the residence — items that matched the description of the property recovered during the earlier traffic stop.

The police report further indicates that Murray told investigators that she had dropped Mullins and Gibson off on a road near a house and she pulled down the road and waited on them. She later went back and picked up the two suspects before being pulled over at the Rio Grande McDonald’s.

Murry was later indicted and charged on February 13 with complicity to burglary for the incident on January 7.

A jury trial has been scheduled in this case on June 26 and a plea agreement may be filed by May 24.

Murry was later released on an own recognizance bond.

According to the clerk of courts online docket, as of press time, no charges relating to the January 7 burglary have been filed against Gibson.

Gibson is facing a charge of receiving stolen property in a 2012 case in which he is alleged to have been in possession of a 46” television, a Simmons Deerfield scope and a craftsman tool bag containing ammunition and a XBox 360 on August 23, 2012 — property he had reasonable cause to believe was stolen.

A status hearing in this case has been scheduled for February 26.

During his hearing last week, Mullins entered a plea of not guilty and his bond was set at $35,000 own recognizance, with an additional $1,500, 10 percent bond.

A plea agreement may be filed in this case by May 17 and a jury trial has been set for June 17.

Mullins previously pleaded guilty in June 2012 to one count of burglary and one count of theft for a 2011 break-in.

According to the indictment in this case, filed on September 23, 2011, Mullins burglarized a residence located on Neighborhood Road between July 14 and July 15, 2011, and stole miscellaneous jewelry from the homeowner.

After pleading guilty to both counts of his indictment last year, Mullins was sentenced on July 25 to serve a two-year probation sentence and was further ordered to serve 60 days in the Gallia County Work Release Center.

He was given credit for time served in the amount of five days and was ordered to pay $1,800 in restitution to the victim.

According to the case file, on October 12, 2012, a warrant was issued for the defendant’s arrest as it was believed that he had absconded supervision.

On December 23, the defendant was arrested and probation violations filed on December 28 indicate that Mullins had failed to make any payments toward his court costs, supervision fee, or restitution in this case. Additionally, the violations state that the defendant had not made any visits to his probation officer since being placed on probation.

An arraignment on the alleged violations was held on December 28 and the defendant later posted bond for his release.

A preliminary hearing was scheduled in this matter on January 11 with a final hearing scheduled for January 28, however, additional violations were filed in this case on January 9 stemming from the second break-in on January 7.

These violations state that on January 7, the defendant was arrested by law enforcement in connection with a burglary that just occurred.

Additionally, the violations allege that the defendant had had contact with a known felon (Gibson) and was in the possession of a firearm — the firearm stolen from the residence — following the burglary.

The defendant was arraigned on these new violations on January 11 and pleaded not guilty.

His bond was set at $1,500, 10 percent.

According to the clerk of courts online docket, the defendant is scheduled to appear for a final hearing in relation to the community control violations on March 4.

The Gallia County Sheriff’s Office website indicates that the defendant is currently being held in the Gallia County Jail.
